1. Introduction

With the present warnings, JG ROBOTICS SRL, VAT ID 04201840982, with registered office in Cazzago San Martino (Brescia), hereinafter referred to COMPANY, establish the rules for the access and the browse of the present website run discretionary by the COMPANY, exclusive ownership of the Company, vehicle of its own initiatives.

 

2. Definitions

2.1. The expression hereinafter conventionally indicated with a capital letter (both singular or plural) have the respective meaning:

  • Terms of sale (TOS): contract terms with those JG ROBOTICS protocols the commercial relations with the site’s navigators and the buyer, as hereinafter defined, by virtue of telematics negotiation
  • Buyer: subject that conclude the contract with the Company. It is defined as consumer the physical or juridical entity that operates for the aim of extraneous entrepreneurial or professional activity possibly conducted (“Consumer”) and as professional the physical or juridical entity that conduct in the exercise of its own professional or entrepreneurial activity (“Professional”). When in the TOS we refer to Buyer, we mean including both the Consumer and the Professional; otherwise we will refer to the involved subject (for example, in the clause related to the right of termination exercisable only by the Consumer)
  • Navigator: subject that browse on the website, committing to respect the guidelines here provided as far as it is concerned, even if it’s not Buyer.
  • Privacy: privacy discipline that the Company publishes on the Website, concerning the processing of the Navigator and the Buyer personal data.
  • Data: personal data of the Navigator or of the Buyer provided according to Privacy, by completing the form for the Website registration.
  • Product: the good object of the single transaction (electronic disposals). All the information regarding the Products collected in the related tab, won’t be bidding for the Company, if not in the form and following the procedures laid down in the TOS.

2.2. Please note that the tab contains the data and the information relevant for the Product and that in case of particular needs is responsibility of the Buyer to ask to the Company additional info on the product.

  • Service: the management of an electronic trading platform aimed for the Navigators for the trade of the product of the Company. Thanks to the Service, in brief, the Navigators can consult the Products catalogues and purchase the Products online. It is understood that the Service is owned and exclusively attributable to the Company, that runs it in an entirely independent way in its own incontestable and discretionary opinion, without prejudice to the application of the TOS
  • PartyCompanyBuyers and Navigators
  • Contract: electronically completed agreement between the Parts for one or more Products between the Parties without prejudice to the application of the TOS. The Contract is considered concluded in the place where the registered office of the Company is.

 

3.  Website access

3.1. The website host a web platform intended for the provision of the Service, thanks to which Navigators can purchase the Products of the Company.

3.2. The access to the website, the consultation of the info related to the Products available on the Website and the registration for the Website is free and free of charge. 

3.3. Without prejudice to the fulfillment of the obligations arising from Contract, the Company does not guarantee continuous and uninterrupted access to the Website, which, by the way, can be influenced by various factors independent of its own control, and to the Service. The access to the Website (including the reserved area for online purchases) may be suspended and/or interrupted at the Company discretion, e.g. for technical reasons of any kind, for entrepreneurial decisions, for the occurrence of a fortuitous case or majeure force, for the violation of the obligations of the Navigator set our below, without, in any case, this latter having anything to claim from the Company.

3.4. The Company, in addition to that, will have the right, at any time, to make changes to the Website and to the access methods to the Service, even if such changes involves a variation of the contents of the Service

 

4. Indictment

4.1. The trade Contracts concluded between the Parties are governed by the TOS, which can be consulted on the General Conditions section of the Website.

4.2 The discipline applied to privacy is contemplated on the Privacy Policy page of the Website. Desiring to ensure the widest guarantees in terms of privacy in favor of data subjects, and in particular, of Navigators and Buyers, the Company has decided to inspire its own Privacy Policy to the discipline established by the European Union, even in case it would not be applicable to the case in point.

 

5. Navigator obligations

5.1. The Navigator undertakes to access the Website and to use the Service in full respect of the mandatory civil, criminal and administrative (local, regional, national, community and international) laws and in particular, but not exclusively, in terms of protection of personal data discipline, in terms of copyright and industrial property, aimed at fighting computer crimes (cybercrimes).

5.2. Without prejudice to the above, but not limited to, the Navigator undertakes: 

  • not to use the Site for illegal, illicit purposes or purposes contrary to public order, morality and morals; 
  • not to use the Site to transmit or disseminate in any way abusive material with respect to the Purpose and Service offered by the Company, illegitimate, illicit, pornographic, racist and / or otherwise obscene, vulgar, defamatory; 
  • not to transmit material and / or messages that encourage third parties to engage in unlawful and / or criminal conduct liable to criminal, civil or administrative liability; 
  • not to send commercial and / or promotional messages or not to engage in "spam", "chains letter" or any other form of illegal communication and / or contrary to the rules of netiquette; 
  • not to infect the network or the computer system that allows the provision of the Service with viruses, malware or other harmful programs that may interfere with, damage, intercept, delete, goods and / or data or personal information, nor to use programs of any type peer to peer or with the same purposes;
  • not to carry out actions that give rise to an unreasonable burden or an excessive IT load on the Site system.

 

6. Link and malware

6.1. While periodically checking the content of the web pages linked from the Site or reachable by advertising banners (and / or other advertising spaces) that may be present on the Site, the Company cannot assume any responsibility for their contents.

6.2. Despite periodic checks on the Site, the Company cannot guarantee that it is free from viruses or other potentially harmful programs. Before accessing the network and carrying out any operation, including, in particular, downloading documents and software, the Navigator must always adopt the most up-to-date protection measures.


 

7. Industrial and intellectual property

7.1. The Navigator acknowledges that trademarks and distinctive signs, contents, information, programs, layouts, texts, images, photographs (including, in particular, those of electronic products), videos and databases used by the Company, as well as any and all technical, conceptual and creative solutions, the contents and / or adopted by the Company on the Site are covered by copyright or are in any case the exclusive property of the Company, unless otherwise indicated in writing, and in any case agreed with the entitled parties .

7.2. Navigators are expressly prohibited from any use of the Site not strictly connected to the purposes pursued by the Company and, by way of example, the reproduction, sale, modification, distribution, transmission, republication, even partial, of the contents, information, programs, layouts, texts, photographs and databases available on the Site and the technical, conceptual and creative solutions adopted
